“Non-commercial expropriation” — Tatiana Tereshchenko’s comment for the Legal Information Agency

The seizure of private property in the interests of business is not allowed. This is the conclusion of the European Court of Human Rights. Similar restrictions are also provided for by Russian law, although its implementation can actually freeze the development of cities.

Tatyana Tereshchenko, head of the Prime Advice analytical department comments:
 
"Only in 2015, the  Land Code introduced a rule specifying the conditions for the withdrawal of land for state or municipal needs. In particular, for construction purposes it is allowed if objects of one or another value are provided for by approved territorial planning documents and territorial planning projects.  This lets "expand" the city on legal grounds".
