“Monopoly of lawyers” — Oleg Ganyushin’s comment for Delovoy Peterburg

Only certified lawyers will soon be allowed to represent companies, sole traders and other participants in court cases. This will lead to a rise in the cost of legal services, primarily for small businesses.

The draft federal law was first read in the state Duma on June 14. In addition to the introduction of the institution of professional representation, or the so-called "legal monopoly", it is aimed at a fundamental reform of the procedural codes.

In itself, the requirement of legal education for the purposes of representation is necessary. A certain "professional qualification" is quite a reasonable condition that allows you to cut off those who do not have appropriate training. But it can be misrepresented in law or practice. In addition, the proposed option is a good intermediate step before the transition to a "lawyer" or fully professional monopoly. While the number of lawyers, the conditions of their exams and the overall level of their training is not 100% meet the expectations of consumers.
