“Rating of industries in which it is impossible to comply with laws” — comments of lawyers of “Prime Advice” for “Delovoy Peterburg”

"Delovoy Peterburg" found out in which types of business strict compliance with all legal requirements is almost incompatible with profitability. A rating of 10 industries was compiled based on a survey of leading lawyers serving entrepreneurs.

Lawyers of "Prime Advice" were asked to assess the main branches of business on a scale from 1 to 10, where 1 means the practical impossibility of making a profit with strict compliance with all legal requirements, and 10 — the most comfortable and reasonable regulation. 

Tenth place. Transport and logistics. Average score — 7.4

According to Oleg Ganyushin leading lawyer of "Prime Advice", it is necessary to put out for brackets area of railway cargo transportation, where the indicator will tend to 10, despite the serious antitrust restrictions. But if we consider road transport, the situation is changing dramatically for the worse — below 5.

"Regulations contain spaces and seriously messed up. Especially in the field of relationships with contractors, which is important, given the huge number of contractors in the transport industry. As a result, both courts and representatives of the industry have serious difficulties with law enforcement. A separate problem is that the activity of freight forwarders in Russia is still not normally regulated. And everything is compounded by the fact that the industry is experiencing serious administrative pressure: regulation of the use of roads, the system of control over movements, requirements for installation of specialized equipment in machines, etc. — all this is historically extremely poor regulation of private relations in the industry is complemented by excessive regulation in the public plane".

Ninth place. Media business, publishing. Average score — 7.33

Compliance with the law in the publishing business is often complicated by the inability to verify the availability of intellectual property rights of the authors due to the lack of appropriate registers, says Elena Lukyanchikova, senior lawyer of "Prime Advice". This, she said, leads to serious disputes related to claims of violation of the exclusive rights of the authors and can lead to significant losses, even if the publisher is not to blame.

"The active work of the Central Bank speaks for itself: the requirements for the sufficiency of bank capital and reserves, limiting the issuance of loans to related companies, etc. As a result, often only those who do not actually need a loan with all the norms can get a loan."

First place. Construction. The average score — 2.55

Inna Vavilova, managing partner of "Prime Advice":

"Acts aimed at ensuring the quality and safety of construction projects and their subsequent operation contain a variety of conflicting requirements or regulations that have long been obsolete and economically unjustifiable, and give state institutions actually absolute power with regard to the control over the implementation of construction activities."
