“Former Owner of Nationalized Company in St. Petersburg Ordered to Pay 58 Million Rubles” — commentary by Tatiana Tereshchenko for Delovoy Peterburg
Rosimushchestvo has recovered 57.8 million rubles from the former owner of a nationalized company. These funds had been loaned to her by the company.
The Arbitration Court of St. Petersburg and Leningrad Region considered Rosimushchestvo's lawsuit against Anna Abrosimova to invalidate a loan agreement and apply the consequences of invalidity — recovering 39 million rubles of debt and 18.7 million rubles in interest from the defendant.
Negative consequences for former owners and affiliated persons when a company transitions to state ownership may include challenges to corporate decisions and transactions that worsened the financial condition,
— says Tatiana Tereshchenko, Head of the Analytical Department at Prime Advice Law Offices.
Additionally, this may involve claims for the return of assets withdrawn under the guise of loans, challenges to contracts concluded by the company, and recovery of damages from former directors.
