“Smolny’s Moscow contractor has declared itself insolvent” — comment by Vitaly Karpenko for Delovoy Peterburg

Moscow NTC LLC "Measurer", Smolny's contractor, which has been collecting almost 350 million rubles from him for the past 5 years, has declared itself insolvent.

It is not yet known whether the state contract with Smolny could have caused the crisis in the "Meter", this issue can be studied as part of the bankruptcy procedure of the company. According to lawyer Vitaly Karpenko, head of projects at Prime Advice, in order to analyze the crisis phenomena in the company's activities, it is necessary to see the whole picture from the inside.

It is likely that a long-term trial could be one of the factors,

— says the expert.

— For example, there were not enough resources to finance other projects. After all, for any company, the amount of 300 million rubles is more than serious and can significantly affect the execution/non-fulfillment of other contracts.

At the same time, the lawyer notes, the most difficult thing in such court proceedings is to predict when the money will be received and whether it will be received at all. Filing a lawsuit in 2020 cannot guarantee a final decision on the case at least in 2025, emphasizes Vitaly Karpenko.

A lot depends on the majority creditors,

— says Vitaly Karpenko.

— If Sber is the main creditor, it is logical to assume that it will apply for the introduction of a competition. However, bankruptcy in practice has also been going on for quite a long time. Accordingly, if by a certain moment a decision is made in favor of the “Meter” for more than 300 million rubles, this may affect the position of creditors and the direction of the bankruptcy procedure. For example, a settlement agreement can be signed at any stage of bankruptcy.
