“LOMO wants to evict two tenants from its main site in St. Petersburg” — Yulia Orlova for Business Petersburg

JSC LOMO is evicting from its land a company whose majority owner is the former general director of the enterprise, Alexander Aronov.

The Arbitration Court of St. Petersburg and the Leningrad Region has accepted for consideration two applications from JSC LOMO demanding that its tenants vacate two land plots on Chugunnaya Street.

According to lawyers, the process of freeing LOMO's plots from tenants can take from several months to several years. For example, one common problem faced by land owners is the tenant's reluctance to remove its property. Moreover, if it is destroyed (or damaged), the tenant has the right to demand compensation for the damage.

Another common problem is that the tenant may evade vacating the plot and dismantling the structures, which requires enforcement.

If there is no tenant property left on the plot and the only issue to be resolved is the tenant's refusal to sign the return acceptance certificate, then the matter will be resolved within several months, depending on the speed of the court decision and its entry into legal force,

— says Yulia Orlova, lead lawyer at Prime Advice Law Offices.
